Flights will operate to / from Tortola if Virgin Gorda is closed due to weather, sunset and other reasons beyond Air Sunshine control. The airport remains closed for a C-402 commuter liner.  Air Sunshine will provide complimentary boat rides to/from Virgin Gorda (Spanish town) Trellis Bay  as long as VIJ Airport remains closed, Service is limited and not available for every  flight, call for details. Flights maybe operated in larger aircraft and/or operated by sister company Suncoast Airlines as on demand charter as defined by FAR 110.2

VIRGIN GORDA NEWS RELEASE

Virgin Gorda is suppose to open On Dec First 2010 however Airport will open as an Uncertificated Airport with Limitations and Restrictions and Cessna 402C being a Commuter Size Aircraft is not being allowed to land by ASSI, this in spite of 12 years of previous continuous service by Air Sunshine, over 50,000 landings and having the world's most experienced VIJ Pilots on the staff.

 Air Sunshine has appealed ASSI's decision to the Governor under article 146 of the Air Navigation Order that gives authority to the Governor to issue exemptions in the public interest. However under advice by ASSI, the Governor has denied this request stating that he can only issue exemptions to the order and not the conditions and restrictions imposed on Virgin Gorda Airport by ASSI. This does not make sense because if a regulation can be exempted then a condition that has less regulatory weight and it is optional in nature should be more logical to waive or exempt. ASSI is making these new rules in contradiction to article 37 and 153 of the Air Navigation Order but are careful to call the new rules conditions in order to circumnavigate their own regulations. ASSI  closed the airport on Jan 28,2010 citing one single rule; 105(6), a generic safety rule that states ASSI has the power to close an airport if it deems it unsafe however safety is not a perception but must be based on trends and mathematical or scientific data and  simply there is no data or records that suggests that operations of C402 in daylight in Virgin Gorda is less safe than operations of large aircraft at night in Beef, in fact 50,000 landings in VIJ from sunrise to sunset is the trend, data and the proof that VIJ is safe for a C402C. ASSI has brought the economy of Virgin Gorda to its knees and continues to show a total disregard for public interest.

 Air Sunshine is prepared to challenge ASSI's decision in court but strongly feels that this is not an Air Sunshine issue and the BVI Government and the public must take a more active role defending their interests and rights.  We hope that we will be given permission to resume flight operations soon but in any case for the time being we will continue our complimentary boat service that has been offered to the public since April first to and from Trellis Bay and Spanish Town. The airport is closed now to public at large since Air Sunshine is the only Scheduled Commuter serving the Virgin Gorda Airport and it appears after a substantial expenditure of money by BVI Government, the airport will be open only to private charter operators using smaller and lighter aircraft and will be only available to few rich customers that can afford it rather than the local residents and the members of the community.

Attached is a news release explaining why Air Sunshine is not able to resume flight operations to/from Virgin Gorda on Dec 1,2010. Posted below is the rules from Air Navigation Order or OTAR that we believe ASSI is in violation of, the attached news release may be forwarded to the  members of the public at the discretion of the recipient.
 

Rules of the Air

37.

(1) The Governor may, by regulation, make Rules of the Air supplementary to but not

inconsistent with the Rules of the Air in Schedule 8.

There is no place in schedule 8 or other parts of ANO that permits the regulators to apply  rules designed for large transport category airplane  (70% landing distance rule) to small normal category aircraft, specifically a US Operator ,the entire ANO and OTAR is also silent in regards to enforcing a crosswind advisory by the manufacturer as a limitation.

An aircraft shall not be operated at an aerodrome or landing site unless:

only authorise use of aerodromes that are adequate for the type(s) of aeroplane and operation(s) concerned

 This is almost identical to FAR 135.229 which states " no certificate holder may use an airport unless it is adequate for the proposed operations, considering such items as size ,surface ,obstructions, and lighting  " ,to the contrary FAR 135.375  requires a large transport category aircraft to land within 70% of a runway. Cessna 402 is not a  large transport category aircraft.

 Unless stated otherwise, this Part applies to: For commercial air transport operations using
aircraft registered in the Territory the operator

Note: That OTAR and the 70% rule  is only applicable to aircraft registered in the territory and not a US operator that has been operating in accorcdance to FAR 135.229 for 12 consecutive years.
 

Exemption from Order

146.

The Governor may exempt from any of the provisions of this Order (other than articles 35,

36, 123, 135, 136, 137, 138, and 147) or any regulations made thereunder, any aircraft or persons

or classes of aircraft or persons, either absolutely or subject to such conditions as he thinks fit.

 Note: The Governor has denied our request for exemption under article 103 to continue operations without the new restrictions and limitations imposed by ASSI.
 

Designation by the Governor

153.

(1) Subject to paragraphs (3) and (4), the Governor, acting in his discretion, may

designate a person to carry out those functions of the Governor under this Order that are specified

in the designation, subject to such conditions as he sees fit.

(2) Subject to paragraph (3), the Governor may revoke or vary a designation made under

paragraph (1).

(3) Before making, revoking or varying a designation made under paragraph (1), the Governor

shall consult with, and take into account any advice given by, ASSI.

(4) The Governor may not include in any designation made under paragraph (1) the functions of

the Governor

(a) to make rules, orders or regulations or give instructions under this Order; or

(b) under this article or articles 113, 152 or 154.

Please note that continued presence of ASSI as the designated person who is authorized to make rules(DCA) is a conflict of interest under item 3 and 4.
